Welcome to 2A BlackMarket. These Terms of Service (“Terms”) apply when you use 2ablackmarket.com (the “Site”) or buy from us. By using the Site or placing an order, you agree to these Terms. If you don’t agree, please don’t use the Site. “We,” “us,” and “our” mean 2A BlackMarket.

What we sell

We sell Second Amendment–themed apparel and accessories, including graphic tees, Hawaiian shirts, and caps. Despite our name, we sell apparel only. We do not sell firearms, ammunition, firearm parts, or any other regulated items. Every item is printed to order by our print-on-demand partner.

Who can buy

You must be at least 18 years old to make a purchase. By placing an order, you confirm that you’re 18 or older and that the information you give us is accurate and complete.

Product images, colors, and sizing

We work to show our products accurately, but images are for reference. Colors can look different from screen to screen, and printed colors may not exactly match what you see online. Small variations in color, print placement, and sizing are normal for made-to-order products and aren’t considered defects. Please check the size chart before you order.

Orders and pricing

All prices are in US dollars. Prices can change at any time, but the price shown when you place your order is the price you pay. Applicable sales tax is added at checkout.

Placing an order is an offer to buy. We may refuse or cancel any order, for example if a product is unavailable, if there’s a mistake in a price or product description, or if we suspect fraud. If we cancel an order after you’ve been charged, we’ll refund you in full.

Payment

Payments are processed securely by Authorize.net. By placing an order, you confirm that you’re authorized to use the payment method you provide, and you allow us to charge it for the order total, including shipping and taxes.

Shipping, returns, and cancellations

Our Shipping Policy and Refund and Returns Policy are part of these Terms. In short: because every item is made to order, we don’t accept returns or exchanges for size or change of mind. If your item arrives damaged, defective, misprinted, or wrong, email us a photo within 30 days of delivery and we’ll send a free replacement or a full refund. Orders can only be cancelled before they go into production.

Satire and opinion

Our designs are political expression, opinion, humor, and satire about the Second Amendment, gun rights, and related topics. They are not statements of fact. They’re not meant to threaten anyone or to encourage violence or any illegal activity. Any reference to a person, organization, brand, or event is commentary or parody and doesn’t mean they endorse or are connected with 2A BlackMarket.

Our designs and content

All designs, graphics, text, logos, and other content on the Site belong to 2A BlackMarket or its licensors and are protected by copyright and trademark law. Buying a product gets you the product. It doesn’t give you the right to copy, reproduce, or sell the design. Please don’t use our designs or content without our written permission.

Using the Site

When you use the Site, you agree not to:

• Break any law or place fraudulent orders
• Interfere with the Site’s security or normal operation
• Copy or scrape our content or designs using automated tools
• Upload viruses or other harmful code

We may suspend or block access to the Site for anyone who violates these Terms.

Third-party services

We use trusted third parties to run our store, including payment processing, order fulfillment, shipping, and analytics. Their services are governed by their own terms and privacy policies, and we aren’t responsible for their websites or services.

Disclaimers

Except as stated in these Terms and our Refund and Returns Policy, the Site and our products are provided “as is.” To the fullest extent the law allows, we disclaim all other warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Some states don’t allow these disclaimers, so they may not apply to you.

Limitation of liability

To the fullest extent the law allows, 2A BlackMarket won’t be liable for any indirect, incidental, special, consequential, or punitive damages related to the Site or our products. Our total liability for any claim is limited to the amount you paid for the product involved. Some states don’t allow these limits, so they may not apply to you.

Indemnification

You agree to protect and hold harmless 2A BlackMarket from any claims, losses, or costs (including reasonable attorneys’ fees) that result from your misuse of the Site or your violation of these Terms.

Governing law and disputes

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Harris County, Texas, and you agree to the jurisdiction of those courts. Before taking any formal action, please email us. Most problems can be solved quickly and informally.

Changes to these Terms

We may update these Terms from time to time. When we do, we’ll change the “Last updated” date at the top of this page. Changes apply to orders placed after the update is posted.
